- Although considerable effort has been made to ensure that the visual representations of Jahan products displayed on the Platforms are representative of the color, design, style, etc. of the original products, slight variations, distortions and/or differences may appear with respect to the original product. Consequently, Jahan cannot be held responsible for apparent differences between the images of the products represented on the Platforms and the original products. - In the event of a breach of any of these Terms of Use, your authorization to use a Jahan Document shall automatically terminate and all copies made of such Jahan Document shall be immediately destroyed. Any unauthorized use of a Jahan Document may violate copyright laws, trademark laws, laws on confidentiality and publicity, as well as regulations and statutes relating to communications.
- Your submissions and unsolicited communications
- This section deals with communications sent to Jahan. It does not concern the communication of personal information to Jahan in relation to customer requests, the use of services or the purchase of products by telephone or through the Platforms, which are governed by the Privacy Policy.
- Any unsolicited communication or material you transmit to Jahan via the Platforms or through social media, email or otherwise, including but not limited to data, questions or answers, comments, suggestions or the like, will be treated as non-confidential and non-proprietary by Jahan. - In addition, Jahan enjoys a worldwide reputation for both the design and manufacture of high-quality luxury goods. To this end, it has its own creative sources, including teams of highly skilled designers who design and perfect Jahan’s creations. As a result, Jahan cannot agree or accept to be the recipient of unsolicited proposals for collaboration. Indeed, it is conceivable that Jahan is already working on similar ideas and/or creations.
- Limitations of Liability
- This section applies to Platforms and not to products that can be sold online or by phone through one of our local or regional markets.
- Jahan strives to ensure that the information provided is accurate and complete. However, Jahan does not provide any guarantee, implicitly or explicitly, with respect to the Website or the Platforms, including, but not limited to, whether any Jahan Document is accurate, exhaustive or reliable, or that the use of said Jahan Document will not infringe the rights of third parties.
- Jahan does not guarantee that the functional and/or technical aspects of the Platforms or any Jahan Documents are free of errors or that the Platforms, Jahan Documents or the servers that make them available are free of viruses or other harmful components. - These Terms and Conditions of Sale apply to all sales of Jahan products or services that you may order from SWISSGEM SA, on the Website and via any associated Platforms (collectively the “Sales Channels”) referring to these Terms and Conditions of Sale.
- By placing an order, you agree to be bound by the Terms of Use and the Privacy Policy, the terms of which are incorporated into these Terms and Conditions of Sale.
- Please note that before ordering products or services, you will be asked to accept these Terms and Conditions of Sale. If you do not accept these Terms and Conditions of Sale, you will not be able to order any products or services through the Sales Channels.
- Sales made through physical outlets (including but not limited to our stores and our booths at retail exhibitions) or through third parties (including, but not limited to, authorized resellers) are not subject to these Terms and Conditions of Sale. Orders made on the Website and collected in one of our physical outlets are also not subject to these Terms and Conditions of Sale.
- Identity and Address Verification: No sale from our Website is final until we have completed our Identity and Address Verification Process, which takes place immediately after you have confirmed and paid for your order. This may involve manual verification measures, including, but not limited to, one of our staff contacting you to request further information, documentation and/or social media accounts to confirm your order, identity and address. If we have not been able to verify your identity and/or address to our satisfaction, we reserve the right to cancel your purchase and provide a full refund.
- Items offered for sale through our Website are subject to availability, and we reserve the right to impose quantity limits on your order, reject all or any part of your order, and discontinue offering items without prior notice, even if you have already placed an order for an item.
- Return Policy (On-line purchases only)
- For items ordered on-line and shipped, you may request a return for items that have not been customized, engraved, embossed, resized, altered in any way or damaged from their original condition for a refund or exchange by clearly informing us of your intention to do so within fourteen (14) calendar days from the date you received the products and stating your reasons. Please inform us by phone (+ 41 22 810 20 20) or e-mail ([email protected]) only. If you are sending us an e-mail, please only use the e-mail you provided when you ordered the item. We reserve the right not to accept or process any returns if you fail to contact us from the e-mail address and/or phone number we verified during our Identity and Address Verification Process.
- Returns must include the original sales receipt and be returned in original, undamaged packaging. You must include the product(s) and all accessories, free items received as part of your order, the Service Guide, Warranty Card and all other documents in their original packaging.
- All returns will be subject to a rigorous Quality Control Process (QC) to determine eligibility for refunds and/or exchanges. Our QC checks for issues including, but not limited to, signs of wear, damage, or alteration (including but not limited to re-sizing and engraving). If a security tag has been removed, the item cannot be accepted for return. If the products do not meet the QC standards, we cannot accept the return. At your request and at our final discretion, the returned products can be sent back to you at your expense.
- We take great care to ensure our products are sold as described and delivered to you in brand new condition, perfectly intact and free of any fault. However, we do not represent or warrant that the descriptions, pricing or other information on our Website is accurate, reliable, complete, up-to-date or error-free. In the rare event of an error, we reserve the right to correct any such errors and revise your order in accordance with the corrections (which includes charging the correct price) or to cancel your order and refund your payment. In the rare event that you find that the product is faulty upon delivery or does not correspond with the description, we will offer a full refund of the price of the purchase and delivery charges once you have returned the items in the same condition in which you received them.
- Only the purchaser shall be entitled to a refund of the purchase price. A person who has received the product as a gift (i.e. the “Gift Recipient”) will not be entitled to receive a refund under any circumstances. If you are the Gift Recipient and wish to return a product, please contact us to discuss your options.
- You must retain proof of return shipment in order to arrange a return and/or refund. We will not be liable if you are unable to provide such proof. Only merchandise received following an order through our Website will be eligible for a refund or exchange.
- We will process your refund as quickly as possible and refund your purchase using the original method of payment. This may take up to 30 business days from receipt of your items depending on your location and payment method.

- We also offer you the possibility to return your online purchase to one of our permanent physical stores for a possible exchange, store credit or refund subject to these Terms and Conditions.
- You may return your online purchase without customization and whose security tag, if any, has not been removed within fourteen (14) calendar days from the date of receipt by you. If you have exchanged the purchased product for another product of higher price you will be charged the difference. Gift Recipients may be entitled to an exchange of equal value, with an original gift receipt only, subject to Terms and Conditions. Store credits may only be redeemed at one of our retail stores and not through an online purchase.
- Non-refundable Items
- Orders for products that have been customized (including but not limited to bespoke orders) cannot be cancelled after a down payment has been received and such products cannot be returned to us for exchange or refund. This includes, but is not limited to, products that have been engraved or embossed.
- Order and shipping confirmation
- We will send you an Order and Shipping Confirmation in writing (by e-mail or otherwise) when we ship your order. This Order and Dispatch Confirmation constitutes acceptance of your order by us and indicates the existence of a binding contract of sale.
- Delivery
- We will use reasonable efforts to ensure that delivery is made by the carrier within the estimated delivery time from the date of our written Order and Shipping Confirmation, unless your purchase is for a product or service that will require additional time for delivery as explained to you, for example, products or services that we customize or manufacture to your specifications.
- When assessing your delivery time, please take into account the time required for payment approval, address verification, security checks and order processing. Please note that delivery is always subject to receipt of your full payment.
- Shipping policy
- We only accept orders for delivery to the countries identified during the Order Process. Please note that we do not ship to certain addresses, such as military zones, certain restricted areas, collection points (including, but not limited to, PickPost, MyPost24, etc.) or post office boxes.
